Successfully represented Rosenbauer AG, the largest European producer of vehicles and devices for in the fire protection industry, in consortium with a Romanian entity, Deltalift, in a challenge of a major public procurement procedure for acquisition of hydraulic platforms by the Romanian State Inspectorate for Emergency Situations, funded with European Union grants. The firm's litigation and public procurement team succeeded to prevail before the court and to overturn a negative result in the administrative-jurisdictional phase of the challenge of the awarding of the contract for the client by the other offeror in the procedure. The result obtained by the team secured the execution of the contract by the client, it being a major victory which confirms the outstanding value of the firm's professionalism and expertise in public procurement litigation.
Represented the Romanian division of the pharma multinational Sandoz, in a very large public procurement dispute related to the provision of medicines for two years for the national programmes of oncologic treatments, carried on and financed from the budget of the Ministry of Health. The procurement procedure had been challenged by the former provider of innovative medicines for the same therapeutic indication, who wanted to preserve his contract and the priority in supply beyond the protection period for the innovative medicine. Nevertheless, both the judicial administrative bodies and the court dismissed the former provider challenges and uphold the decision of the contracting authority to organize the purchase of generics, allowing the client to bid for this publicly funded health program.
Representing MBS Group, a major Romanian construction business, in the challenge of a large public procurement procedure regarding the construction of a sports facility in the town of Oradea, NW Romania. The case is very complex, involving numerous law areas on the substance of the case.

The firm's team, led by Alina Nica, was requested by Mercedes-Benz Romania to issue an interesting and challenging legal opinion related to a procurement procedure to which the client participated and which also have been won by it. The challenge was given by the fact that during the procedure the client’s activity was divided and part of its activity was attributed to a new entity of Daimler Group. The team had to identify the solutions to maintain the performance of the agreement by either of the two entities, with the consent of the contracting authority and with full compliance of the Romanian legislation.
The law firm's team, led by George Ionescu, assisted the 4th District of the Bucharest Municipality during the expropriation procedure performed by the client in order to implement a public utility project, namely the rehabilitation and modernization of Giurgiului Road, one of the most important roads in Bucharest and of its surrounding areas, connecting the Romanian capital to the southern zone of the country. The value of the expropriation procedure was approx. €685,000 and the total investment cost of the public utility project reached to approx. €652,000.
The team, led by George Ionescu, offered full consultancy services to the Market Department and Activity Management of the 4th District of Bucharest Municipality, with respect to public procurement procedures performed for acquiring the necessary services related to its activity, advised the public entity on aspects related to its day-to-day issues, analyzed and legally approved the conclusion of all public procurement agreements concluded by it and assisted the client during negotiations with all suppliers and economic operators which intended to rent a commercial space within the markets under the administration of our client.

Representing a major contractor in a litigation before the competent Romanian courts in connection to a contractual dispute regarding an important public procurement contract against a local authority. The contract referred to the construction works of an important recreation park. The public authority claimed for penalties for the alleged delay in termination of the works and also for damages representing the alleged European funding lost because of the said delay.
Assisting and representing one of the biggest Romanian companies in the field of production of automobiles, superstructures, containers and chassis market, with over 75 years of experience, in a litigation concerning the recovery of the litigation costs incurred by the client, as the winning tenderer in a public procurement procedure, in its capacity as ancillary intervener in support of the contracting authority within a previous litigation concerning a public procurement procedure organized by the largest Romanian natural gas producer and supplier. The procedural law issues raised by this litigation were very complex, given the controversial nature of the right of the accessory intervener in support of the contracting authority to recover its own litigation costs from the losing party, although the ancillary intervener voluntarily decided to intervene within the proceedings to support the position of the contracting authority. Despite many unfavourable decisions of the administrative jurisdictional authority for public procurement, and non-unitary judgements rendered by the Romanian courts, the team successfully implemented a rigorous legal strategy that led to the recognition of the ancillary intervener's right and its vocation to recover the litigation costs in full. The argumentation line was grounded on the peculiarities of the litigations in the matter of public procurement contracts and the special nature of the procedural interest to act of the winning tenderer in a public procurement procedure, as the latter is particularly interested in maintaining a favourable result). This solution is of practical and theoretical interest especially in the matter of public procurement proceedings and the effectiveness of review procedures concerning the award of public contracts.
Representation of the major contractor in various administrative-jurisdictional appeals before the National Council for the Settlement of Appeals either as appellant or as respondent, as well as subsequently, before the court.
Representing a major contractor in a dispute arising from a joint venture agreement between two participants in the execution of a contract for the execution of works at a major airport in Romania. In this dispute, Stoica & Asociații seeks compensation for the client, given that he ended up performing the contractual obligations assumed jointly by himself, so that he suffered significant damages. The dispute is in the first instance, before the Bucharest Tribunal.
Representing a major contractor in litigation against the contracting authority (a major national airport company) for the recovery of unpaid sums for works performed under the public procurement contract, as well as contractual penalties for late payment. In this dispute, Stoica & Asociații raised an exception of unconstitutionality of the legal provisions that require the payment of a stamp duty calculated not according to the value of the claims, but according to the value of the public procurement contract. The dispute was suspended until the exception of unconstitutionality was resolved.

The total value of the contracts is of over EUR 500 million over the past years. Our team has succeeded to win in courts and won the project for its a market-leading supplier of products and services for the power generating industry in public procedures where the public contract was awarded to competitors of our client. The claim initiated against our clients was in regard to alleged breach of contractual obligations and the recovery of certain amounts allegedly owed by the consortium.

Successfully defended Northstone (NI) Limited in first instance and appeal before the Tribunal and Court of Appeals in a complex claim exceeding EUR 2,7 mil. filed by its Romanian partner under a joint-venture procurement agreement. The claim referred to material damages for an alleged failure to perform management services under the joint-venture as well as moral damages for alleged reputational damages incurred by the Romanian partner due to the filing by our client of an insolvency claim.

Legal assistance and advice to FCC Environment România SRL in relation to public procedures initiated by Arad County and Neamt County authorities with the purpose of awarding to private businesses the performance of public sanitation and waste management services through concession contracts. Such concession contracts imply a transfer of the risks related to the performance of such services from the public authorities to a private entity. We are currently assisting the client with regard to the preparation of tender documents, advice regarding interpretation of certain provisions of the tender documentation, drafting requests for clarifications and potential initiation of various challenges against the documents issued in these public procurement procedures.

The firm successfully defended L3 COMMUNICATIONS – UK Ltd in a public procurement dispute initiated by the National Airport Company (CNAB) for the payment of approx. EUR 330,000 as delay penalties following an alleged breach of a procurement agreement for the provision of airport equipment consisting of a delayed upgrade of airport security scanners. Although the first instance court ruled in favour of CNAB, the decision has been reversed irrevocably in appeal in favour of our client.
