NNDKP represented the National Museum of Romanian History (MNIR) and obtained an irrevocable court decision that annulled in full the New MNIR public procurement proceeding.
By Decision No. 7072 of December 11, 2018 the Bucharest Court of Appeals irrevocably dismissed the complaint of Starh Arhitectură, Construcții și Design SRL filed against MNIR, and upheld the decision for the annulment in full of the award procedure issued by the MNIR Director. The procedure referred to a public procurement contract worth over EUR 3.6 million, exclusively for the design part, which was concluded in relation to the third largest building in the country, namely the MNIR building located at 12 Calea Victoriei Street, Bucharest. The NNDKP team, consisting of attorneys specialized in the public procurement and dispute resolution fields, was involved both in the initial stage of the dispute, directed at the annulment of the procedure, and during the trial proceedings, after the MNIR annulment decision was challenged in court.
The NNDKP team that assisted MNIR consisted of Ana Diculescu-Șova, Senior Partner and Head of the Dispute Resolution practice of NNDKP, Cătălin Radbâță (Partner), member of the Dispute Resolution practice, and Adina Chilim-Dumitriu (Partner), Alexandru Aman (Senior Associate) and Cristian Dranca (Senior Associate), members of the Public Procurement and PPP practice.
"We are honored to have had the opportunity to represent the National Museum of Romanian History in such a complex dispute and we are pleased with the favorable outcome of the litigation. This is but another example of the benefits that come with NNDKP’s integrated approach to litigations, through the cooperation of the teams of specialists in public procurement and dispute resolution areas”,declaredCătălin Radbâță, Partner.
NNDKP's Dispute Resolution Practice coordinated by Ana Diculescu-Șova is independently recognized as a force in the field of litigation, being constantly top-ranked by reputed international guides such as Chambers and Partners (the European edition) since 2007, and The European Legal 500 guide since 2002. With 10 Partners coordinating a team of over 50 litigators active in Bucharest and in the other three regional offices (Timisoara, Cluj-Napoca and Brasov), NNDKP has the necessary resources to handle complex cases, which include several parties or extend over many years, and can offer sustainable strategies in order to mitigate potential future risks.
